Unfair competition law

In the world of business, competitors repeatedly copy products and release misleading, disparaging advertising intended to force competitors out of the market. The applicable legal framework can be found in the Swiss Act against Unfair Competition. The Act against Unfair Competition targets excessive competition, and instead of being implemented ex officio by the regulatory authorities, it is implemented by market participants in civil proceedings.

We represent our clients in civil and criminal proceedings presided over by regulatory authorities and the courts. In particular, our services include advice on:

  • Misleading, imitative or disparaging advertising

  • Risk of confusion over product packaging

  • Use of abusive general terms and conditions (GTCs)

  • Unfair poaching of customers

  • Marketing and communication projects
